Terms of Service

1. Nature of Service

Independent Platform: LandOpps is an independent search and research layer. We are not affiliated with, endorsed by, or a part of any government agency, including the California State Water Resources Control Board (GeoTracker) or the Department of Toxic Substances Control (EnviroStor).

Research Tool: Our service provides an automated full-text search of public environmental records. This tool is designed to assist professionals in their due diligence but does not constitute a legal or environmental certification of any kind.

2. Eligibility

You must be at least 18 years of age to use LandOpps. By creating an account, you represent and warrant that you meet this requirement and that you are using the platform for lawful professional purposes.

3. Plans, Pricing & Trial

Plans & Pricing: LandOpps offers subscription plans and, where available, one-off research engagements. Current plan details and pricing are published on our website. By subscribing, you agree to pay the fees associated with your selected plan.

Trial Period: New users may access a 7-day free trial. A valid credit card is required to start the trial. At the end of the trial, your account will automatically transition to the applicable paid plan unless canceled before the trial period ends.

Ad Hoc Engagements: One-off research engagements are governed by these Terms unless a separate written agreement is executed between you and LandOpps.

4. Cancellation & Refund Policy

Cancellations: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing cycle.

No Refunds: Subscriptions are non-refundable regardless of billing frequency (monthly or annual). No partial refunds will be issued for unused portions of a billing cycle. Fees for ad hoc research engagements are non-refundable once work has commenced.

Termination by LandOpps: If LandOpps terminates your account for reasons other than a violation of these Terms, monthly subscribers will receive a refund of the current month's fee, and annual subscribers will receive a pro-rated refund for the unused portion of their billing cycle. No additional refunds or compensation will be provided.

Billing Errors: If you believe a billing error has occurred, contact us promptly and we will investigate and correct any confirmed errors.

5. Fair Use & Anti-Scraping Policy

To maintain the integrity of our search infrastructure for all users, we enforce a strict Fair Use policy.

Human-Only Access: Use of the platform is restricted to human users. The use of bots, spiders, scripts, or any automated software to harvest data or mirror our search index is strictly prohibited.

Usage Limits: All search access is subject to reasonable professional research volume. LandOpps reserves the right to temporarily suspend or throttle accounts showing non-human behavior, such as thousands of searches in a short timeframe.

No Reselling: Users may not download, repackage, or resell search results or metadata from the LandOpps index to third parties.

6. Disclaimer of Accuracy & Liability

No Guarantee of Accuracy or Completeness: LandOpps aggregates and indexes data from official state sources. Public records may contain errors, omissions, outdated information, or missing documents at the source level. LandOpps does not guarantee the accuracy, completeness, or currency of any data presented through the platform. All information is provided on an "as-is" and "as-available" basis.

Professional Verification Required: Users are solely responsible for independently verifying all findings through official state portals and original source documents. LandOpps provides direct links to official government records wherever possible. No information obtained through LandOpps should be treated as a substitute for professional verification with authoritative sources.

No Professional Advice: Nothing provided through LandOpps constitutes legal, environmental, financial, or professional advice of any kind.

7. Limitation of Liability

To the maximum extent permitted by law, LandOpps's total liability to you for any claims arising from or related to your use of the platform shall not exceed the total fees you have paid to LandOpps in the twelve (12) months immediately preceding the claim.

In no event shall LandOpps be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether such damages were foreseeable or whether LandOpps was advised of the possibility of such damages.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Subject to the dispute resolution provisions in Section 9, any legal proceedings arising out of or relating to these Terms or your use of LandOpps shall be brought exclusively in the state or federal courts located in the State of California, and you consent to the personal jurisdiction of such courts.

9. Dispute Resolution

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the use of LandOpps shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in California, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as part of a class, consolidated, or representative action.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.

10. Indemnification

You agree to indemnify, defend, and hold harmless LandOpps, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the platform; (b) your violation of these Terms; (c) your reliance on any data obtained through LandOpps; or (d) any third-party claim resulting from your use of information obtained through the platform.

11. Intellectual Property

Proprietary Index: While the underlying PDFs are public records, the LandOpps search index, keyword extraction logic, custom filters, and user interface are the proprietary intellectual property of LandOpps.

Protection: Any attempt to reverse-engineer our indexing logic or search algorithms will result in immediate termination of service without a refund.

12. Force Majeure

LandOpps shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, government actions, changes to government data sources or portals, internet or infrastructure outages, cyberattacks, pandemics, or acts of war. During any such event, LandOpps's obligations under these Terms shall be suspended for the duration of the event.

13. Modification of Terms

LandOpps reserves the right to modify these Terms at any time. We will notify you of material changes by email at the address associated with your account. Your continued use of the platform following notification constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you may cancel your subscription before the start of your next billing cycle.

14. Termination

We reserve the right to terminate access immediately and without refund for any user found in violation of the Fair Use, Anti-Scraping, or Intellectual Property provisions of these Terms.
